SMS Mobile Messaging Program Terms of Use

We, along with our partner SpotHopper, offer a mobile messaging program (the "Program"), which you agree to use and participate in subject to these terms ("Terms"). By opting into or participating in the Program, you agree to these Terms, including your agreement to resolve any disputes with us and/or SpotHopper through binding arbitration, as detailed in the "Dispute Resolution" section. These Terms apply only to the Program and do not modify other agreements with us or SpotHopper.

Agreement to Receive Messages

You agree to receive SMS messages from us and SpotHopper at the phone number you provided when you opted in and any updated number you provide. These messages may include subscription management information, special offers, and other promotional content. Your consent to receive these messages is not required to make a purchase. Message and data rates may apply.

Opting Out

If you no longer wish to participate in the Program, you agree to reply STOP to any mobile message from us or SpotHopper. You may continue receiving messages while your opt-out request is processed, and you may receive a confirmation message. Other methods of opting out, including verbal requests or texting other words, are not considered valid.

Notification and Responsibility

If you decide to stop using the phone number you provided, you agree to complete the opt-out process before discontinuing use. Failure to do so may result in you being responsible for any costs or liabilities incurred due to claims related to the reassignment of that number. You agree to indemnify us and SpotHopper for any such claims.

Program Description

The Program includes messages about events, products, services, and special promotions.

Cost and Frequency

Message and data rates may apply. The Program involves recurring messages, and additional messages may be sent based on your interaction.

Support Instructions

For support, text HELP to the number from which you received messages or email support@spothopperapp.com. Opting out must follow the outlined procedure.

Disclaimer of Warranty

The Program is provided "as-is" and may not be available in all areas or may cease functioning due to changes by your wireless carrier. We and SpotHopper are not liable for any delays or failures in message delivery.

Participant Requirements

You must have a wireless device capable of two-way messaging and a participating wireless carrier with text messaging service.

Age Restrictions

You may only use the Program if you are at least 13 years old. If you are between 13 and 18, you must have parental or guardian consent.

Prohibited Content

You agree not to send fraudulent, offensive, violent, or illegal content, including content violating laws regarding personal health information.

Dispute Resolution

Disputes will be resolved through binding arbitration administered by the American Arbitration Association (AAA). Arbitration will be conducted individually, and class arbitration is not permitted.

Miscellaneous

You represent that you have the necessary authority to agree to these Terms, and no provision of these Terms conflicts with any other obligations you may have. We reserve the right to change these Terms at any time. You will be notified of any changes, and by continuing participation, you agree to the updated Terms.
